1. Identification of the service provider
The Gastro Lab service is provided by Gastro Lab, based in Switzerland. For any contractual communication: adrian@gastrolabacademy.com.
2. Object of the contract
Gastro Lab is an online professional training platform aimed at the hospitality industry. Through the gastrolabacademy.com site, users access video courses, reading materials, evaluations, certifications, and team management tools. These terms govern the use of the platform by any registered person, whether as Manager, Owner, or Employee.
3. Acceptance of the terms
Registration on the platform implies the express acceptance of these terms. If the user does not agree with any clause, they must refrain from registering and using the service. By checking the acceptance box during registration, the user states that they have read, understood, and accepted these terms in their current version.
4. Account types
4.1 Manager account (B2B)
Aimed at owners, directors, floor managers, and team leaders in hospitality establishments. Allows purchasing courses for company employees, managing the team, assigning training, and reviewing progress.
4.2 Personal account (B2C)
Aimed at individual industry professionals who wish to train independently. The personal account does not allow team management.
Opening a personal account requires being at least eighteen years old. A manager may register employees aged sixteen or seventeen; in doing so they declare that they hold the authorization of those exercising parental responsibility or guardianship where the applicable law requires it, and assume responsibility for having obtained it.
5. Pricing and payment methods
Every charge on the platform, without exception: · Single course: $29.90 per course and per person. · Course Plus: $32.80 per course and per person. That is the course above plus twenty follow-up questions: one paid block of ten and a second block of ten given free with the purchase. · Additional block of ten follow-up questions: $2.90. · Reactivation of a course whose 30-day period has expired: $9.95. · Intro Pack: free. Amounts are shown in the currency the platform displays according to the country the purchase is made from (CHF, EUR or USD); the figure is the same in every case. The applicable currency is shown before the purchase is confirmed. All are final prices for a one-time payment: no tax or later surcharge is added, there is no recurring fee and there is no automatic renewal. Accepted payment methods include bank card (Visa, Mastercard, American Express) and other means enabled by our payment provider. The invoice is issued after confirmed payment and sent by email. Gastro Lab may change its prices at any time. The applicable price is the one in force and displayed at the moment the purchase is confirmed; a later change does not affect what has already been acquired. If the activity should in future become subject to an indirect tax by legal requirement, Gastro Lab may pass it on to purchases made after that date, giving prior notice in accordance with the section on amendments to these terms.
6. Course access
Once payment is confirmed, the buyer and assigned employees immediately access the content. Platform access does not expire: it is acquired once and is not subject to renewal. Each assigned course has 30 calendar days to be completed, counted from the day the manager assigns it, whether the employee logs in or not. Once that period has elapsed the course is blocked and the manager can reactivate it; reactivation has a cost of $9.95. The block affects that course only: the account and any other courses stay active. The diploma obtained remains verifiable through its code. The number of employees with access is limited by the acquired license. Once a license is consumed, it cannot be transferred to another employee unless expressly authorized by the provider. Access is maintained for as long as the service remains in operation. Gastro Lab may update, replace or withdraw specific content in order to keep it current, preserving a service of value equivalent to the one acquired. Should Gastro Lab decide to discontinue the service, it will notify registered users at least ninety calendar days in advance; during that period the user may download any diplomas still within their download period and request a copy of their data.
7. Certification
Upon completing all modules of a course and passing the final evaluation, Gastro Lab issues a personalized certificate, downloadable for the twelve months following its issue and verifiable online via its unique code. After those twelve months the document can no longer be downloaded; the qualification obtained and its verification via the code do not expire and remain available permanently. The certificate certifies the training on the platform and does not replace official qualifications, regulatory licenses, or professional accreditations required by the local regulations of each country.
8. Cancellation and refund policy
B2C users residing in the European Union or the European Economic Area have a right of withdrawal of fourteen calendar days from purchase, except where they have begun consuming the digital content, in which case, in accordance with applicable regulations, the right of withdrawal expires. B2B purchases are not refundable once the content has been accessed. For specific issues, please contact adrian@gastrolabacademy.com.
9. User responsibility
The user agrees to use the platform in accordance with current law, not to share their credentials with third parties, not to attempt to access other accounts, and not to download, redistribute, or reproduce the content outside the terms of the contract. The training content is a professional reference and must be complemented with compliance with the local regulations applicable to each establishment. Breach of the obligations in this section entitles Gastro Lab to suspend access to the affected account immediately and, if the breach is serious or repeated, to terminate the contract. The suspension will be communicated to the user and, where the nature of the breach allows it, a period will be granted to remedy it. Diplomas already obtained remain verifiable through their code.
10. Intellectual property
All Gastro Lab content, including videos, texts, evaluations, visual identity, code, and design, is the exclusive property of the provider or holds a valid license. Reproduction, distribution, public communication, transformation, or commercial exploitation, in whole or in part, without prior written authorization, is prohibited. Infringement may give rise to corresponding civil and criminal actions.
11. Limitation of liability
Gastro Lab provides a general professional training service. The practical application of the content at each establishment is the responsibility of the user, who must ensure compliance with food safety, health, labor, and any other regulations applicable in their jurisdiction. The provider is not liable for damages arising from misuse of the content or from technical interruptions beyond its control. Gastro Lab's liability for damages arising from the provision of the service is limited to the amount actually paid by the user in the twelve months preceding the event giving rise to the claim. Indirect damages, loss of profit and loss of data or business opportunities are excluded. These limitations do not apply in cases of willful misconduct or gross negligence, nor do they affect the rights granted to consumers by mandatory law. Gastro Lab is not liable for non-performance due to force majeure or causes beyond its reasonable control, including outages of the infrastructure, hosting or communications providers on which the service depends.
12. Data protection and processing on behalf of the client
The processing of users' personal data is governed by the Privacy Policy, which forms part of these terms. Where a client company registers its employees on the platform, that company is the controller of their data and Gastro Lab acts as processor on its behalf. That processing is governed by the Data Processing Addendum, which regulates the subject matter, the duration, the categories of data and of data subjects, the instructions, the security measures, the authorized sub-processors, the assistance in exercising rights, the notification of breaches and the return or deletion of the data at the end of the relationship. Gastro Lab uses infrastructure and email delivery providers that act as sub-processors. The current list is available on request from the client, and Gastro Lab will give notice of any change sufficiently in advance for the client to object.
13. Modifications to the terms
Gastro Lab reserves the right to modify these terms at any time. Modifications will be notified by email to registered users with a minimum of thirty calendar days prior to their entry into force. Continued use of the service after entry into force implies acceptance of the updated version.
14. Applicable law and jurisdiction
These terms are governed by Swiss law. For any dispute arising from the contractual relationship, the parties submit to the courts of the canton of the provider's registered office, without prejudice to the mandatory consumer rights provided in their jurisdiction of residence.
